1. Acceptance of Terms
By accessing or using Shelfies ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
Shelfies is a personal book tracking application that allows users to organize their reading library, track reading progress, set goals, and receive AI-powered recommendations.
3. User Accounts
- You must provide a valid email address to create an account.
- You are responsible for maintaining the security of your account credentials.
- You must be at least 13 years old to use the Service.
- One person may not maintain more than one account.
4. Free & Pro Plans
Shelfies offers a free tier and a paid Pro subscription:
- Free: Core book tracking, shelves, reading goals, and basic statistics.
- Pro: AI-powered recommendations, advanced analytics, premium themes, and additional features.
5. Subscriptions & Payments
- Pro subscriptions are billed monthly or annually through Stripe.
- Subscriptions automatically renew unless cancelled before the renewal date.
- You can cancel your subscription at any time through your account settings.
- Refunds are handled in accordance with applicable law and at our discretion.
6. User Content
You retain ownership of all content you add to Shelfies (book entries, notes, shelves). By using the Service, you grant us a limited license to store and process this content solely to provide the Service to you.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to gain unauthorized access to any part of the Service.
- Interfere with or disrupt the Service or its infrastructure.
- Reverse engineer or attempt to extract the source code of the Service.
- Use automated systems to access the Service without permission.
8. Intellectual Property
The Shelfies name, logo, and all related designs, code, and content are the property of Shelfies. Book cover images and metadata are the property of their respective publishers and rights holders.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the maximum extent permitted by law, Shelfies shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
11. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately.
12. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Shelfies operates, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in that jurisdiction, and the parties hereby consent to personal jurisdiction and venue therein.
13. Dispute Resolution & Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitration shall be conducted under the rules of a recognized arbitration body in the jurisdiction where Shelfies operates.
- You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action.
- The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
- You waive any right to a jury trial or to participate in a class action.
14. Indemnification
You agree to indemnify, defend, and hold harmless Shelfies, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any content you submit through the Service.
15. Force Majeure
Shelfies shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, power failures, internet or telecommunications failures, or cyberattacks.
16. Changes to Terms
We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
